An updated advocates attendance form was introduced on 22nd April 2014 for all FAS hearings taking place on or after that date. The form takes account of the change to the single family court; however it also now includes an additional box to indicate the length of any lunch adjournment.
It has of course always been the case that any lunch adjournment should be removed when calculating the FAS fee (s7.133 of the Family Specification for the 2013 Standard Contract). The Legal Aid Agency has previously been looking for evidence that there was no lunch adjournment (e.g a copy of the attendance note) and / or confirmation in the claim form or covering letter. It will be important to ensure that you are completing the new section of the form, even if it is just a case of entering zero minutes in the box.
