On the 2nd December 2013 changes were introduced regarding the remuneration of counsel in civil non family work. For cases started after that date counsel will be paid at the same hourly rates as solicitors in courts up to and including the High Court and the Upper Tribunal. The changes do not apply for Queen’s Counsel.
As part of the changes counsel is required to provide the instructing solicitor with a breakdown of the time spent on a CF1 form where their fees are to be included in the solicitor's bill at the conclusion of proceedings. This week the Legal Aid Agency have issued guidance to counsel for the completion of the CF1 and you should ensure that counsel provides you with a copy of the form in all applicable cases.
