FAS Fees for the Single Family Court
The introduction of the Single Family Court in April will result in some slight changes to the family remuneration schemes as rates and fees are based upon the level of Court that a case is heard in. The changes will mean that the level of Judge hearing the case will be the determining factor instead.
Full details of the changes can be found in Annex B of the response to the consultation and this now includes the specifics in respect of the Family Advocacy Scheme:
Consultation Response
As an example, when calculating a FAS fee in a care case, the current levels of FPC, County Court and High Court will be directly replaced by the following categories:
Lay Justices, Justices’ Clerk, Assistant Justices’ Clerk
District or Circuit Judge
High Court Judge
None of the FAS fees have been reduced. There will be further consultation on whether there needs to be changes to the way that the court bundle bolt-ons are set up in view of anticipated amendments to Practice Direction 27A.
