Costs Round-Up #8
Welcome to a round-up of the best costs-related news and posts published this week.
Nigel Poole QC presents “Court fees hike” or “keep calm and handover the money” – we can’t help thinking this is a huge cash flow issue for Claimants in the short term, but it's also a massive funding issue for Defendants (as paying party) in the long term. This topic is explored in more depth by Gordon Exall, Barrister here and we remind you the implementation date for the Court fees hike is set for 9th March 2015. Kerry Underwood gives some timely advice on Court Fee Remissions
Costs budgeting chaos leaves Courts on the verge of collapse - the Law Society Gazette reports. The litigation system will ‘cease to function’ unless radical changes are made to costs budgeting, a senior judge has warned. Master David Cook, of the Queen’s Bench Division, a clinical negligence specialist commented “the entire costs budgeting process needs to be re-drawn and parties given detailed guidance about what is expected of them”.
Keep up to date with the All New Part 36 presented by Andrew Hogan Costs Barrister which provides an annotated version of the new CPR rules coming into force April 2015. Andrew also presents his comments on replacing provisional assessment and proposes an alternative scheme based on mediation which is worth a read.
A short round-up this week but a lot happening and in the meantime, if you have a blog on costs related matters and would like to submit your post to the round-up, e-mail: Ilkley@johnmhayes.co.uk
