To reduce by 10% the hourly rates and fixed fees payable in Section 31 Care and Supervision Proceedings. FAS fees have not been reduced.
To update the remuneration schemes to take account of the introduction of the single family court. The rates and fees will be determinable by the level of Judge hearing the case rather than the level of the Court.
The amended regulations apply to cases in which the application for legal aid is dated on or after 22nd April 2014. The old rates will still apply in the following circumstances:
Substantive Applications
The application for legal aid is signed and dated before 22nd April 2014 and received by the LAA before 5pm on 29th April 2014.
An application is submitted in CCMS before 22nd April.
Emergency Applications
A determination for emergency representation is made before 22nd April and the determination is notified to the director within 5 working days.
An application is emailed or faxed to, and received by, the director before 22nd April 2014
An application is submitted in CCMS before 22nd April.
