Still Recovering 2017: Costs Awards in Publicly Funded Cases
Working in partnership with London Legal Support Trust, Christopher McClure (regional manager) and Kenny Shealey presented a topical and practical training session last week in central London on how to maximise costs awards in publicly funded cases.
Frequently overlooked, this could be a real source of additional recovery for every law centre, agency and solicitor firm caught in the post LASPO legal aid funding deficit that is impacting so heavily on access to justice.
Christopher’s advice was workable and pragmatic : ask for costs orders; ask for costs orders on specific issues and if it is not possible to secure that costs order, claim an enhancement on the prescribed rate.
The topic was the subject of a lively and productive Q & A session with many delegates using the opportunity to seek advice on particular challenges and share frustrations.
Top Tip – there were many but here’s one to take away:
Always check with the Legal Aid Agency that you have discharged your duty to protect the fund.
